UK Trade Mark Registration Form
Why Register a Trade Mark?
The registration of a trade mark is the only way you can comprehensively and exclusively protect your product name, business name, company name and/or logo. A registered trade mark also allows you to put the ® symbol next to it.
Benefits of Trade Mark registration.
A registered trade mark:
- may put people off using your trade mark without your permission;
- makes it much easier for you to take legal action against anyone who uses your trade mark without your permission compared with the only other option of relying on “unregistered earlier user rights” or the “laws of Passing-Off”;
- allows Trading Standards Officers or Police to bring criminal charges against Counterfeiters if they use your trade mark;
- is your property, which means you can sell it, franchise it or let other people have a licence that allows them to use it.
The use of the registered symbol ® will also warn others against using it. However, using the ® symbol for a trade mark that is not registered is an offence.
Duration of Registration
Trade marks registered in the United Kingdom or European Community are renewable every 10 years.
Process for registering a UK Trade Mark
It will take approximately 3-4 months to register a trade mark in the United Kingdom. However, if an objection is raised against the application during examination or if a third party opposes the application when it is published for opposition purposes then this will delay the registration of the trade mark.
Money Back Guarantee
We understand that our clients would like a guarantee that their trade mark will be successfully registered. Unfortunately, the successful registration of a trade mark can never be guaranteed. Nevertheless, our advanced trade mark clearance searches are highly advanced. If our Opinion provided in our Advanced searches is that the proposed trade mark is distinctive enough for registration purposes and that it is unlikely to be confused with any earlier registered trade marks then (as of March 2014) 100% of the trade marks are successfully registered.
In the unlikely event that a trade mark is refused registration following our Opinion provided within our Advanced searches that the trade mark should qualify for registration then we will refund our legal fees back to our client (excluding the Statutory fees that is payable to the Registrar).
